BRITNEY Spears’ ex Sam Asghari’s lawyer has been ordered to file more documents in the case of their legal separation or request a dismissal.

New court papers obtained by The U.S. Sun and filed on Friday, October 27, in Los Angeles Superior Court feature a notice sent to Sam’s attorney, Neal Raymond Hersh.

Shelley Kaufman, Supervising Judge for the Family Law Division, is asking the actor’s counsel to take the necessary steps for the case to move forward.

They include having the summons and petition delivered to the other party and then filing a proof of service with the court, along with completing a Declaration of Disclosure and having it delivered to the other party.

“If you do not want to proceed with this case, you must file a Request for Dismissal with the Court,” the filing reads.

This means Britney has likely not yet been sent divorce papers.

Sam’s attorney is being asked to participate in a status conference now set for November 15 at 8.30am.

“If you file a Proof of Service or Request for Dismissal before the hearing date listed above, you do not need to participate in this Status Conference,” the document adds.

CASE DELAY

The U.S. Sun has reached out to Neal Raymond Hersh and Sam’s manager for comment but did not immediately hear back.

If a proof of service or request for dismissal is not filed and they fail to participate in the status conference, Sam may have to pay a court fine and the case will be dismissed, according to docs.

Sam, 29, first filed for divorce on August 17, just 14 months after they tied the knot in a lavish wedding at Britney’s home and celebrated with A-list stars including Madonna.

He cited “irreconcilable differences” as his reason for ending the marriage, according to TMZ.

Sources accused Britney, 41, of cheating on Sam, but she is still yet to confirm or deny the claims, while he has not spoken publicly about the rumors.

An insider told ET Online at the time: “Britney and Sam have split. She’s adamant she didn’t cheat. The two haven’t got along for a while and it finally came to an end after a major blowup.”

TMZ reported that Sam is asking for spousal support from Britney and asking that she cover his attorney’s fees.

PRENUP DRAMA

His lawyer has also suggested that Sam may contest his and Britney’s current prenup.

Court documents maintain Britney’s assets as separate property, not marital assets.

His initial divorce filing, however, states: “[Sam] has yet to determine the full nature and extent of the separate property and assets and obligations of each party.”

It also says: “There are various items of community and quasi-community assets and debts, the full nature and extent of which are unknown to [Sam] at this time.”

Britney has retained high-power attorney Laura Wasser, according to Variety, who has worked with major Hollywood stars.

The pop star will also continue working with Mathew Rosengart – her powerhouse lawyer, known for getting her out of her conservatorship.

Sam and Britney, who had been together for years before getting married, signed a prenup leading up to their wedding.

The music video performer confirmed that he and his then bride-to-be were signing “an iron-clad prenup” in September 2021 – shortly after they got engaged.
