Taylor Swift fan has dropped her lawsuit against Live Nation Entertainment and Ticketmaster over the Eras Tour ticket sales debacle.

Michelle Sterioff, the lead plaintiff in a federal class action lawsuit against the companies, filed to dismiss her complaint which alleged the companies allowed scalpers to purchase tickets, Billboard reported on Wednesday.

Sterioff submitted a voluntary dismissal notice on December 12 in a California federal court.

 

A prior filing in the case suggested that Sterioff was actively involved in settlement negotiations. It’s unclear if a settlement was reached.

Weeks after last year’s botched presale of Eras Tour ticket’s in November 2022, Sterioff alleged that Ticketmaster violated antitrust laws and participated in anticompetitive and misleading conduct.

The presale debacle saw widespread service delays and website crashes as millions of fans tried – and many failed – to buy tickets.

In her initial complaint, Sterioff and her lawyers claimed, ‘Ticketmaster intentionally and purposefully misled millions of fans into believing it would prevent bots and scalpers from participating in the presales.’

They continued, ‘However, millions of fans were unable to purchase tickets during the TaylorSwiftTix Presale and the Capital One Presale, due in large part to unprecedented website traffic caused by Ticketmaster allowing 14 million unverified Ticketmaster users and a “staggering’ number of bots to participate in the presales.”‘

After the Nov. 22, 2022 incident, Live Nation apologized to fans and blamed a ‘staggering number of bot attacks’ and ‘ unprecedented traffic.’

The fallout included a furious response from Swift herself.

She said she was ‘assured’ the company could handle the high demand for tickets and ‘it really pisses me off that a lot of them feel like they went through several bear attacks to get them.’

The Department of Justice also increased the pressure on the company and launched an antitrust investigation into the owner of Ticketmaster, Live Nation Entertainment.

Sen. Amy Klobuchar (D-Minn.), the chair of the Senate subcommittee for antitrust issues, suggested at the time that regulators consider ‘breaking up the company’ – a reference to Live Nation merger with Ticketmaster in 2010.

In November 2023, Reuters reported that the investigation was still in progress, with federal investigators concentrating on whether Live Nation enforced anticompetitive agreements on venues.

According to Politico’s July report, the Justice Department might bring an antitrust lawsuit against Live Nation and its subsidiary Ticketmaster by the conclusion of the year.

Ticketmaster has previously denied using anti-competitive practices and said it remained under a consent decree with the Justice Department following the 2010 merger, adding that there was no ‘evidence of systemic violations of the consent decree’.
